In addition to the provisions of the Information Technology Act, 2000, and other applicable laws, the Company affirms its adherence to the Consumer Protection Act, 2019. The services offered through the Platform qualify as "services" under the CPA, and users are entitled to all protections and remedies available under that law. Nothing in these Terms shall restrict or override the statutory rights of consumers under the Consumer Protection Act, 2019.
The Platform is owned and operated by Stargram Entertainments Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at Door No. 46/3583-G1, Level 8, Nippon Q1, NH 66 bypass, Vennala P.O., Ernakulam, Kochi – 682028, Kerala (hereinafter referred to as “Company”, “we”, “us” or “our”). These Terms and Conditions (“Terms of Use”) constitute a legally binding agreement between you and the Company governing your access to and use of the Platform and the services offered therein. By using or accessing the Platform, you agree to comply with and be bound by these Terms of Use.
The Platform provides professional consultancy and advisory services to students seeking to pursue medical and healthcare education abroad, including MBBS and Nursing programs. These services include, but are not limited to, academic profiling, shortlisting of suitable universities and countries, application processing, documentation and visa assistance, interview preparation, counseling sessions, and post-arrival support. While the Company endeavors to provide accurate information and assist students at every stage, the final decisions regarding admission, visa issuance, and other external processes rest solely with third-party institutions and authorities. Therefore, the Company makes no guarantees regarding admission or visa approvals.
Users may access the Platform to explore services, request consultations, submit documents, or communicate with the support team. By using the Platform, you agree to provide complete and accurate information during the consultation process and to comply with all applicable laws and regulations. You further agree not to misuse, disrupt, or attempt to gain unauthorized access to any portion of the Platform. Any fraudulent activity, impersonation, or misrepresentation may result in immediate suspension of access to the Platform and may also lead to legal proceedings, including civil and/or criminal action, as applicable under law.
Certain services provided by the Company are subject to fees, which will be communicated in advance. Payment must be made as per the agreed milestones or schedule. Refunds, if any, shall be processed in accordance with our detailed Refund and Cancellation Policy available on the Platform. Users are encouraged to review the Refund and Cancellation Policy before making any payment, as it outlines the specific scenarios and conditions under which refunds may or may not be applicable. Users are advised to retain proof of payment for any future reference. The Company reserves the right to revise its pricing structure, introduce new fees, or update its payment terms without prior notice, and such changes shall be applicable prospectively.
Unless otherwise stated, all original content on the Platform, including but not limited to proprietary text, graphics, logos, videos, and software, is the intellectual property of Stargram Entertainments Private Limited and is protected under applicable IP laws. Certain content, such as third-party logos, university materials, stock images, or licensed assets, may be the property of their respective owners and used under license or for representational purposes. Users are granted a limited, non-exclusive, and non-transferable right to access and use the Platform for personal, non-commercial purposes only. Unauthorized reproduction or redistribution of any Platform content is strictly prohibited and may result in legal action.
The Platform may include references or hyperlinks to third-party websites, including but not limited to university websites, embassy portals, and external service providers such as payment gateways. The Company has no control over the content, terms, or practices of such third-party websites and assumes no responsibility or liability for any loss or damage arising from your use of them. Users are solely responsible for accessing and reviewing the terms and policies of such third-party sites. The Company disclaims all liability arising from the use or misuse of third-party platforms.
The Company provides the Platform and its services on an "as is" and "as available" basis without any warranties, either express or implied. The Company does not warrant that the Platform will be uninterrupted, timely, secure, or error-free. Nor does it make any warranties as to the accuracy, completeness, or reliability of the services or content. Any reliance on the Platform or its services is at the user's own risk. The Company disclaims all warranties, including but not limited to those of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of data, income, business, goodwill, or reputation, arising out of or in connection with the use of or inability to use the Platform, even if the Company was advised of the possibility of such damages. This limitation of liability shall apply irrespective of the cause of action, whether in contract, tort, negligence, or otherwise.
You agree to indemnify and hold harmless Stargram Entertainments Private Limited, its directors, officers, employees, affiliates, and agents from and against any losses, liabilities, claims, damages, costs, or expenses (including legal fees) arising out of or related to your breach of these Terms of Use, your violation of any law or rights of a third party, or your misuse of the Platform.
The Company shall not be held liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, civil disturbances, labor disputes, technical failures, acts of government, pandemics, or interruptions in internet or telecommunications services.
Your use of the Platform is governed by our Privacy Policy, which explains how we collect, process, store, and use your personal data. By using the Platform, you consent to the Company’s handling of your personal information in accordance with applicable laws and the Privacy Policy.
The Company reserves the right to suspend or terminate your access to the Platform or associated services at any time, without prior notice, in case of any suspected breach of these Terms, misuse of services, or unlawful activity.
In the event of termination, your right to access the Platform and related services will immediately cease. If services were prepaid and not fully rendered, refunds or settlements will be handled in accordance with our Refund and Cancellation Policy.
You may also request to terminate your use of the Platform and associated services at any time by contacting our support team. Such termination will be subject to the applicable refund terms.
Upon termination by either party, we may retain submitted documents for regulatory or legal compliance purposes or delete them upon verified request. Any clauses which by their nature should survive termination (including indemnity, disclaimers, and limitations of liability) shall continue to remain in effect.
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ernakulam, Kerala, without prejudice to the rights of consumers under applicable law.
If any provision of these Terms is held to be unlawful, void, or unenforceable for any reason, then that provision shall be deemed severable from the remaining Terms and shall not affect the validity and enforceability of any remaining provisions. The remaining Terms will continue in full force and effect.
The Company reserves the right to revise or update these Terms of Use at any time. All changes shall become effective upon posting on the Platform. It is your responsibility to review the Terms periodically. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
